Terms and Conditions of Use

Welcome to the Littler's website, the website of Littler's Design Limited, this is the user agreement for littlers.com

You are required to accept these Terms and Conditions in order to use this website if you are not prepared to accept these conditions you must leave this site immediately. By using this site you consent to these terms and conditions, which are a legal agreement. Which may be updated and modified by Littler's Design Limited at their sole discretion.

Intellectual Property Rights

This web site is owned and registered by Littler's Design Limited.

All trademarks, logos, registered or not registered, displayed on the site are owned by Littler's Design Limited and will remain the exclusive property of Littler's Design Limited. These may not be used in connection with any item or service that does not originate from Littler's Design Limited.

By using this site you agree and acknowledge that all contents, including but not limited to all images, photographs, drawings sketches, icons, illustrations, information, text, content, data, html code, software owned by or licensed to Littler's Design Limited and is subject to protection by international intellectual property laws. Including but not limited to copy rights, trade names, trade secrets, trade marks, service marks, patent rights, design rights, moral rights and any other similar rights recognized under international laws or international conventions in any country or jurisdiction in the world. Any contents or content of this site may not be reproduced, distributed, published, republised, transmit, made derivative works of, modified, or tampered with, in whole or in part, by any means, for any reason or purpose what so ever and is prohibited.

Use of site

This site is for non-commercial use only. It may not be used as a form of research for or on behalf of a commercial company. You may not use this site to commercially exploit, copy, reproduce, publish, modify, create derivative works from, collect data from, or for any commercial purpose. You use this site at your own risk. You agree that you will be personally responsible for your activity. We reserve the right to deny you access to this site or part of this site at any time with out prior notice.

Collecting Data

Data collected for the News Letter is solely for the use of Littler's Design Limited to supply you with a news letter that is relevant to you and will not be given out to third parties. In compliance with the data protection Act 1998 you have the right ask to remove your data from the sites data base and Littler's Design Limiteds records by contacting customerservices@littlers.com

Information collected by the Littler's Online Store is for the purpose of processing the order, this data will be shared with contracted partners for the purpose of fulfilling the order.

The site may collect data on our behalf using cookies. This enables us to remember you and how you use the site.

Product Information

The site aims to provide accurate information photographs, drawings, sketches, product descriptions, measurements are provided to give as accurate a description as possible this however can only give an approximate idea of the item and can not be used as a guarantee.

Pricing

Prices are listed in British Sterling exclusive of delivery. Payments may only be made in British Sterling. The price includes VAT at 20% UK Tax. We try to be as accurate as possible in pricing, if for some reason there is an error in the pricing you will be contacted by email as soon as possible to ask if you wish to continue with the order at the correct price or if you would like to cancel the item. There is no obligation for the item to be offered at the incorrect price. Packing and delivery costs will be added for UK delivery. You are responsible for adding the correct delivery rate for your destination. Orders will not be sent if the Interntional Delivery costs are not correct for your destination.

Ordering

Any customer is advised to print a copy of these Terms as they include Terms and Conditions of Sale

Orders are accepted by email after the receipt of cleared funds if the correct email address is provided. At our sole discretion we reserve the right at all times to refuse any orders. Orders placed on this site are for personal or gift use of the buyer only they are not for resale commercial purposes or any other commercial benefit.

All orders are subject to acceptance and availability.

Order Acceptance

Once your order has been placed you will receive an email acknowledging your order this is not acceptance of your order.

Your order will be accepted before being dispatched for delivery.

We reserve the right not to accept your order. We may refuse a transaction for any reason or refuse service at any point at our sole discretion. We will not be liable for any reason or for any third party reason for refusing to process a transaction or canceling any transaction after processing has begun.

Payment

Visa, MasterCard, Visa Electron, Eurocard, American Express, Switch, Maestro and Delta, can be used to make payment. Payment will be debited from your account and cleared on receipt of your order by Paypal. All credit/debit cards are subject to checks. By using the credit/debit card you are confirming that it is yours. If payment is refused we are by no means liable for any delay or non-delivery. No credit card details are held on this site. In order to provide a safe secure shopping experience card transactions are processed using Paypals secure pages. Every care is taken to ensure your order details are secure, we cannot be held liable for any loss you may suffer from an unauthorized third party making unauthorized access to any data when you are accessing or ordering on the site.

Delivery

Littler's Online Store does not deliver orders to PO Boxes or Hotels. We recommend delivery to a home address or place of work, or the home address of a third party as a gift, deliveries need to be signed for. Delivery will take place up to 30 days after the receipt of full payment for the goods, it is up to you to supply the correct delivery address and information for the goods. Each item is insured until it is delivered, once delivered and signed for the item is yours and no longer insured by us.

If an item delivered does not correspond with the ordered item you are with in your statutory rights to return that item. If the item cannot be replaced with the correct item a full refund will be issued. See returns below.

Returns

Littler's Online Store provides a returns service for items bought through the littlers.com Online Store website up to 7 working days after the delivery of the item. Items must be returned as sent, unworn, with all the original packaging, tags, and any instructions in perfect condition. You will need to obtain an Authorized Item Returns number (AIR) from us. No goods will be accepted with out an Authorized Item Returns number and returned to sender. We recommend items are sent carefully packed, fully insured, registered post. We are not responsible for loss or damage of goods in transit.

The purchasers account will be reimbursed within 30 days of receipt of the returned item, the account the original item was purchased from. Items and packaging returned incomplete, used, spoilt or damaged in non-saleable condition will not be refunded. Original delivery costs will not be refunded unless the item is proved faulty. We advise checking items thoroughly before disposing of packaging or removing tags.

Rights to Refuse

Littler's Design Limited reserves the right to refuse a service or customer use of the site.

Links

The failure to enforce a term and condition of use or a term and condition of sale does not constitute a waiver of such rights and does not mean the they will not be acted upon in the future or on a separate occasion.

Limitation of Liability

We will not excluding liability for death or personal injury resulting from our negligence. We will not be liable for (including, but not limited to, negligence and strict liability) any direct, indirect, special, loss of revenue, loss of profit, contract, loss of business, good will, reputation,or indirect or consequential damages arising out of or in connection with this agreement.

Any service or item that may have been provided does not guarantee that this service or item will be available at any time. Changes or improvements may be made at any time. Littler's Design Limited goes to great effort to ensure the smooth running of the site however reserves the right at any time to update, modify, discontinue temporarily or permanently the site with out prior notice.

We have no liability of any sort (including negligence) for other providers of telecommunication services faults or failures, of their networks and equipment.

Imdemnity

You agree to indemnify and hold harmless against all liabilities. We are not responsible for any claim or demand, legal fees for any third party due to arise out of any breach of this agreement or your violation of any law or rights of a third party.

Governing Law Jurisdiction

Entering this web site confirms that you agree to accepting English Law. Should any dispute arise English Courts of Law will have exclusive jurisdiction.
